articles.
Present : Sh. Sukhbeer Singh, ld. Chief P.P. for the State.
Sh. Amit Gupta, ld. counsel for the applicant/accused
Nirmal Singh.
IO/Insp. Bharat has sent a reply to the application.
Ld. Counsel for the applicant/accused has submitted
that his mobile phone having SIM No. 9896442548 and one bag
along with wallet having his original Aadhar Card, Voter ID Card,
PAN card, ATM card of Bank of Baroda and Rs. 300/- were seized
while he was arrested by the police. Ld. Counsel for the
applicant/accused prays for release of the abovesaid articles which
were seized during personal search of the applicant/accused.
Ld. Chief P.P. for the State submitted that as per
reply filed by IO, he has no objection if the personal search articles
i.e. one black purse containing his Aadhar Card, Voter ID Card,
PAN card, ATM card of Bank of Baroda and Rs. 300/- be released
to him. It is urged that mobile phone of applicant/accused was not
a part of his personal search memo and same was seized through
separate seizure memo as it is a case property, which is required to
be sent to FSL Rohini for examination and as such same may not be
released to the applicant/accused.
I have perused the reply and personal search memo
of applicant/accused filed by IO.
