ORDER
This order will decide the point of cognizance.
Arguments were heard on the point of cognizance.
Perused the chargesheet filed by the IO alleging
commission of offences under Section 7 of Prevention of
Corruption Act, 1988 and Section 120-B of Indian Penal Code by
the accused persons namely Meetu Goswami, Junior Assistant,
Delhi Jal Board and Deepak Kumar, Senior Assistant, Delhi Jal
Board.
Ld. PP for the State submitted that both the accused
persons are liable to be prosecuted under Section 7 of Prevention
of Corruption Act, 1988 and Section 120-B of Indian Penal Code
as there is sufficient material against them. He further submitted
that accused, Meetu Goswami, Junior Assistant in collusion with
another accused, Deepak Kumar, Senior Assistant demanded and
accepted Rs.20,000/- as illegal gratification from the complainant
Sh. Keshav Singh for clearing a family pension file during
discharge of their official duties and accused Meetu Goswami
while receiving the bribe money was caught red handed under
the trap proceedings.
Further, two sanction orders under Section 19 (1) (c)
of POC Act, 1988 i.e. order dated 06.11.2025 with respect
to accused Meetu Goswami and order dated 13.11.2025 with

respect to accused, Deepak Kumar, both issued by Dr. Kinny
Singh, IAS, Member (Administration), have been attached along
with the supplementary chargesheet which was filed on
29.01.2026.
Perusal of the chargesheet including the documents
filed therein, the statements of the witnesses as well as the FSL
reports shows that there is sufficient material for this court to
take cognizance of the above mentioned offences and to proceed
against the accused persons namely Meetu Goswami and Deepak
Kumar. Accordingly, I hereby take cognizance of the offences
under section 7 of the Prevention of Corruption Act, 1988 and
Section 120-B of Indian Penal Code.
