Meetu Goswami alongwith the said accused.
IO Inspector Pawan Kumar has sent a request seeking exemption
from appearance for today. For the reasons stated in the application, the same is
allowed and the IO is exempted from his appearance for today.
In this case, chargesheet has been filed but the FSL result and
sanction are awaited. Let notice be issued to the investigating officer to disclose
the status of sanction on the next date.
The Naib Court has informed that he has spoken to the IO and has
been informed that the FSL report has not been received. In terms of order
passed by Hon’ble Supreme Court in Joshinder Yadav vs State of Bihar,
Criminal Appeal No. 259/2009 dated 20.01.2014, let notice be issued to the
concerned officer with whom the said examination is pending, to appear and to
submit his explanation for delay in furnishing the report.
Copy of this order and copy of the letter requesting for FSL
examination shall be sent alongwith notice.
