Reply is filed by CBI in response to application
filed by Pramod Kumar, S/o Sh. Raj Ballav Ray (father-in-law of
accused/deceased Priyaranjan Kumar) u/s. 497 and 498 BNSS
for removal of lien and de-freezing of bank account. Copy
supplied.
In the reply, CBI has revealed that it has not passed
any direction or order for freezing of bank account of the
applicant in the present case. CBI has further denied that bank
accounts of the applicant at SBI or PNB were frozen subsequent
to their directions in the present case. It is also stated in the reply
that as per records maintained in the CBI file, no
communication , request or direction had been issued by the IO
of this case to freeze the bank accounts of the applicant. Under
such circumstances in view of the reply filed by CBI, the relief
prayed for in the application filed by the applicant becomes
infructous as any such lien or order of freezing has not been
passed in the present case, either by the Court or on orders of the
IO during investigation. Hence, no direction is liable to be passed
to the Bank Manager of PNB, Sansad Marg or any other bank.
Application is accordingly disposed off as relief is not made out.
