Matters are listed for judgment.
Ld counsel for the appellant on the last appearance after
conclusion of arguments has placed on record photographs
to show that similar commercial activities are being run from
the shops adjacent to the shops of the appellant on the
same road but no action has been taken against them and
only the appellant has been targeted because of a writ
petition filed by one Sh. Sushil. It was further stated even
Mr. Sushil is using his shop for the similar activities.
The respondent being a government authority is required to
take action against all the shops carrying activities which
are prohibited under MPD-2021 and cannot be permitted to
pick and chose. MCD is directed to filed status report along
with photographs to show what action has been taken
against the other shops abutting the same commercial road
on which the shops of the appellant are located.
Put up for awaiting status report and arguments on
