Sh. Atul Tanwar, Ld counsel for defendant no.4 / MCD through
V/C.
Sh. Mahmood Hasan, Ld counsel for defendant no.1 to 3.
Written statement alongwith reply to the application under
Order XXXIX Rule 1 & 2 CPC and certain annexures have been filed on
behalf of defendant no.1 to 3. Copy supplied.
Plaintiff is at liberty to file replication, if any, with advance
copy to the defendant no.1 to 3 at least 7 days prior to the NDOH.
Ld counsel for defendant no.4/ MCD submits that the present
matter has been marked to him yesterday only and he seeks time to file
status report.
Defendant no.4/ MCD is directed to file status report in terms
of previous order on the NDOH.
Defendant no.4/ MCD is further directed to file written
statement within statutory period and reply to the interim application within
15 days from today with advance copy to the plaintiff.
Ld counsel for defendant no.1 to 3 submits that no construction
is going on over the suit property at present and it is further submitted that
no unauthorized construction shall be carried out in the suit property till the
NDOH.

Defendant no.1 to 3 are directed not to carry out any
unauthorized construction in the suit property till the NDOH.
Put up for consideration on application under Order XXXIX
Rule 1 & 2 CPC on 21.03.2025.
