Sh. AA Qureshi, Ld. counsel for defendants with
defendant no.1.
Perusal of the record shows that on 14.05.2025, Ld.
counsel for the plaintiff had pressed for adjudication of application
under Order 39 Rule 1 and 2 r/w Section 151 CPC.
Thereafter, on 17.05.2025, adjournment was sought by
defendant no.1. Thereafter, on 11.06.2025, joint adjournment was
sought by both the parties and thereafter on 14.07.2025, none had

appeared on behalf of plaintiff and consequently a cost of Rs. 5,000/-
each was imposed on both the parties for causing delay in the present
matter. Thereafter, matter was fixed for today.
Today also, none has appeared on behalf of plaintiff
despite repeated calls.
In view of the same, last and final opportunity is granted
to the plaintiff to pay the cost and to address arguments on the
application under Order 39 Rule 1 and 2 r/w Section 151 CPC failing
which the right of plaintiff to address arguments on the said application
shall stand closed.
Defendant no. 1 undertakes to pay the cost of Rs. 5,000/-
on or before NDOH.
At this stage, Ld. counsel for the defendants submits that
he will be filing an application to bring additional documents on
record.
Allowed.
Put up for arguments on the application under Order 39
Rule 1 and 2 r/w Section 151 CPC and filing of the application under
Order 8 Rule 1A CPC on 28.01.2026.
