Defendant no.1 in person.
Notice of the application filed on behalf of plaintiff for
early hearing issued to defendants received back served.
An application has been filed on behalf of defendant no.1
and 2 under Order 8 Rule 1 r/w Section 151 CPC for condonation of
delay in filing written statement. Same is taken on record. Copy
supplied.
Ld. counsel for defendant no.1 and 2 submits that
inadvertently the written statement could not be filed by defendant no.1
and 2 within the prescribed period due to the reasons as mentioned in
the application and prays that the application be allowed and written
statement filed by defendant be taken on record.
Ld. counsel for plaintiff submits that he has no objection if
the written statement filed by defendant no.1 and 2 is taken on record.
In view of the above and in the interest of justice and
keeping in view the settled principle of law that procedure should be
used to subserve and advance the cause of justice, the application filed
on behalf of defendant no.1 and 2 under Order 8 Rule 1 r/w Section 151
CPC is allowed.

Accordingly, written statement filed by defendant no.1
and 2 is taken on record.
Furthermore, the application for early hearing filed on
behalf of plaintiff also stands allowed and is disposed of.
Ld. counsel for plaintiff presses for adjudication of
application filed on behalf of plaintiff under Order 39 Rule 1 and 2
r/w Section 151 CPC.
Ld. counsel for defendant no.1 and 2 requests for
adjournment stating that she is out of town and requests for
adjournment.
Heard. Allowed.
Put up for arguments on 17.05.2025 at 2 pm.
Date already fixed i.e. 08.08.2025 stands cancelled.
