Fresh vakalatnama filed on behalf of JD. Same is taken
on record. Perusal of the record shows that v.o.d 19.07.2024 a decree of
possession of shop no. 3517/11 and 3517/12 situated on first floor in
Kumar building, Qutub Road, Sadar Bazar, Delhi-110006 was passed
in favour of the DH alongwith other consequential relief.
Upon query it has been jointly stated by both the counsels
that there is no stay upon the said decree.
Let warrants of attachment of the movable articles of the
JD as per list be issued (subject to Section 60 of CPC), on filing of PF,
returnable for 24.02.2026. DH is also directed to file affidavit of no
stay/ no appeal along with PF.
DH is directed to appear before Ld. ACJ for appointment
of bailiff on 06.02.2026. Bailiff is directed to break open the lock and
doors of the house of the JD, if required for the execution of warrants
of attachment of movable property. Bailiff is also at liberty to take the
assistance of the police concerned for execution of warrants of
attachment. Let warrants of possession of the suit possession of the suit
property i.e. Shop no. 3517/11 and 3517/12 situated on first floor in
Kumar building, Qutub Road, Sadar Bazar, Delhi-110006 be issued
against the JD with permission to break open the locks on filing of PF.
