As per report of the Ahlmad, WS filed on behalf of respondents alongwith
an application under Order VIII Rule 1 CPC on 11.04.2026. Copy supplied to the
opposite side in advance.
In the application seeking condonation of delay, it is inter-alia stated that
summons were served upon the respondents on 28.01.2026 and as the counsel for
respondents was not available, WS could not be filed within time.
As per record, the WS was filed on behalf of respondents on 10.03.2026,
whereas the summons were served upon them on 23.01.2026.
For the reasons stated therein and subject to cost of Rs.5000/- to be
paid by the respondents to the petitioner on NDOH, said WS is taken on record.
Replication filed on behalf of petitioner. Copy supplied to the opposite side.
Application is disposed off accordingly.
Petitioner is directed to file affidavits of all the witnesses within two weeks
from today after supplying advance copy to the opposite side. Both the parties are
directed to file list of witnesses, within 15 days from today with advance copy to each
other.
Put up for PE and arguments on the aspect of Section 15 (1) of the DRC on
04.08.2026.
