Ld. Counsel for the defendant has filed the written
statement alongwith application under Order 8 Rule 1 seeking
condonation of delay of 34 days in filing of WS.
Heard. Perused.
It is no gainsay that procedure is the handmaid of justice
and procedural delays should not be allowed to subvert the very cause
of justice. Every effort should be made to hear the parties on merits.
Moreover, the grievance of plaintiff regarding delay can be duly
compensated by way of cost. Hence, the application seeking
condonation of delay is hereby allowed and WS is taken on record,
subject to cost of Rs. 1,000/- to be paid to plaintiff on NDOH.
Let replication, if any, be filed on the NDOH with
advance copy to opposite side against receipt.
Let affidavit of admission/denial of documents be also
filed by both the parties and proposed issues, if any, on the NDOH.
At this stage, Ld. Counsel for the plaintiff has raised
certain objection regarding the draft of the WS. Ld. Counsel for the
defendant is directed to supply the properly signed/ verified WS to the
plaintiff.
List for filing of affidavit of admission/denial of
documents / settlement of issues on 25.03.2026.
