Present : Ld. Counsel for petitioner alongwith petitioner.
Petitioner has not deposited the cost imposed vide order dated 25.02.2025.
An application for waiver of said cost has been filed on behalf of petitioner on
the ground that the petitioner has not deliberately delayed the case and it has happened due to
lack of knowledge.
In such circumstances, said cost is reduced to Rs.4,000/- to be deposited by
petitioner in DLSA, Central, THC during the course of the day and receipt be filed.
An application under Order VI Rule 17 CPC has also been filed on behalf of
petitioner seeking amendment of the petition. Amended memo of parties and copy of the
amended petition has been filed alongwith the application.
Petitioner has not mentioned in the application as to which para he seeks to
amend, however, it is argued that only para no.3 pertaining to relatives of the deceased has
been amended and there is no other amendment in the petition.
For the reasons stated in the application and in the interest of justice and in view
of the last order dated 25.02.2025, application under Order VI Rule 17 CPC is hereby
allowed. Amended memo of parties and amended petition are taken on record.
On filing of PF and RC within seven days from today, issue notice of present
petition to respondents no. 5 to 13 to appear on NDOH.
Be put up for appearance of new respondents on 22.05.2025.
