Succ. Court 119/24
GAGAN SACHDEVA Vs. STATE AND OTHERS
25.02.2025
Present : Ld. Counsel for petitioner alongwith petitioner.
Matter is listed for final arguments.
During the course of arguments, it has come to light that mother of deceased Smt
Vidhyawanti has passed away in 2021 i.e. subsequent to the deceased who passed away in the
year 1985. Upon query of the Court, Ld. Counsel for petitioner submits that Smt. Vidhyawanti
had other children namely Sh. Ramesh Sachdeva, Smt. Santosh, Smt. Raj, Smt. Savita and Smt.
Usha. It appears that petitioner has deliberately left out such essential and important details from
the petition which reflects extremely negligent and casual conduct of petitioner and his counsel. It
is also noticeable that such children of Smt. Vidhyawanti being essential and necessary parties to
the present petition have not been impleaded due to casual conduct of the petitioner.
Accordingly, matter is adjourned subject to a cost of Rs. 6,000/- to be deposited by
petitioner in DLSA, Central, THC. Let receipt thereof be placed on record within two weeks from
today. Petitioner is given last and final opportunity to amend the petition and to state the actual
facts regarding distribution of estate of the deceased Sh. SC Sachdeva amongst his heirs as per the
Hindu Succession Act, 1956.
Petitioner is directed to file a detailed family tree of the deceased alongwith the date
of death of every legal heir specified under Class-I in the Schedule appended in the Hindu
Succession Act, 1956 alongwith their death certificates. Needless to say, petitioner shall also
explain the distribution of share of Smt. Vidhyawanti i.e. mother of deceased as she has passed
away in 2021 (i.e. after the deceased) amongst her legal heirs in view of section 15 and 16 of
Hindu Succession Act, 1956.
Be put up for further proceedings on 18.03.2025.
