It has been reported by the Nazir that the address of the JD
pertains to New Delhi District.
An application under Section 39 of CPC has been filed for
issuance of transfer certificate.
The address of the JD is out of territorial jurisdiction of this
Court; accordingly, though execution petition had to be filed in this Court only
as decree was passed by this Court, however, in view of Section 39 (4) of
CPC, this Court deems fit to issue transfer certificate.
As per the memo of parties the JD is based at Naraina Village,
New Delhi – 110 028 which falls within the New Delhi District and therefore,
this Court does not have the requisite jurisdiction to hear the present matter.
Let transfer certificate be issued as per law. Dasti be given as
per law, as prayed for.
Application disposed of as allowed.
File be consigned to Record Room, after due compliance.
