Sh. Shrey Kaushal, ld. counsel for defendant.
On 21.12.2023, amended memo as well as copy of GST
details have been filed by Ld. Counsel for plaintiff.
Accordingly, summons were issued, however, reports qua
ordinary process, RC, Speed Post as well as esummons have not been
received back.
Ld. Counsel for defendant submits that defendant received the
summons through WhatsApp on 08.01.2024 and accordingly, written statement
was also filed within the prescribed period of limitation.
On 27.01.2024, written statement along with Vakalatnama and
list of documents filed on behalf of defendant. Copy stated to be received.
Further plaintiff is directed to provide fresh and legible copy of
invoices as relied upon by him to the defendant against due acknowledgement.
Since the present suit pertains to recovery of money. Both the
parties are directed to appear before National Lok Adalat scheduled to be
held on 09.03.2024 for exploring the possibility of settlement.
To come up for verification of settlement, in any, in default for
filing of replication, with advance copy of the same to opposite party,
admission/denial of documents as well as for framing of issues, on 30.03.2024.
Parties are directed to file affidavit of admission/denial of documents as well as
proposed issues on or before the next date of hearing.
