Matter is at the stage of arguments on application under
Order XXXIX Rule 1 and 2 CPC filed on behalf of the plaintiff.
Adjournment is sought by Ld. proxy counsel for plaintiff
on the ground that the main counsel is not available. Allowed.
Ld. Counsel for the defendant submits that the defendant
had restored electricity in the tenanted premises but the plaintiff has
failed to pay rent for the months of June, 2024, February, 2025,
September, 2025 and October, 2025, and has also failed to pay the
electricity charge in terms of order dated 26.12.2025. He further
requests that the plaintiff be directed to pay the rent for the above-
mentioned months.
In view of the above, plaintiff is directed to pay the rent
for the months June, 2024, February, 2025, September, 2025 and
October, 2025, if not already paid and if the plaintiff had paid the rent
for the said months to the defendant, he is directed to file proof of the
same. Plaintiff is also directed to comply with order dated 26.12.2025
w.r.t. electricity consumed by him.
Interim order to continue till next date of hearing.
List the matter on 21.05.2026.
