NIKHIL JAIN Vs. SHARWAN KUMAR
20.04.2026
Proceedings conducted through hybrid mode.
Present: Mr.Anurag Sharma, Ld. Counsel for the applicant
(through VC).
Mr. Ashish Rana, Mr. Phillip Massey and Mr.
Piyush Sharma, Ld. counsel for applicant /plaintiff
Mr. Atul Pandey, Ld. Counsel for the defendant/non-
applicant.
Ld. Counsel for the defendant submits that the
plaintiff has not complied with order dated 19.03.2026, whereby
he was directed to pay rent for the months of June, 2024, February,
2025, September, 2025 and October, 2025 and he has also not filed
any proof thereof.
At this stage, Ld. Counsel for the plaintiff submits
that in the legal notice dated 01.11.2025 that was sent to the
plaintiff by the defendant, neither rent of the above-said months
has been mentioned by the defendant nor it has mentioned that
Rs.2,000/- per month had to be paid by the plaintiff as electricity
charges. Ld. Counsel for the defendant also acknowledges the said
fact.
At this stage, Ld. Counsel for the plaintiff submits
that the plaintiff has video recording in a pen drive showing that
electricity connection has been cut off in the shop of the plaintiff.
The said video recording has been played in the computer system
of the Court. After seeing the same, Ld. Counsel for the defendant
submits that electricity connection has not been disconnected by
the defendant.

Perusal of the file shows that on 26.12.2025 also,
defendant was directed to restore the electricity connection in the
shop of the plaintiff forthwith.
At this stage, Ld. Counsel for the defendant submits
that the plaintiffs have not paid the electricity charges since the
inception of tenancy, i.e. August, 2023 and he acknowledges that
the defendant has not filed any case against the plaintiff for
claiming the said amount. He further submits that defendant is
paying the electricity charges for the tenanted premises every
month. He further submits that in the WS, defendant has claimed
that rent of the tenanted premises is Rs.15,000/- (which is
exclusive of Rs.2,000/- as electricity charges).
At this stage, Ld. Counsel for the plaintiff submits
that the rent amount of Rs.15,000/- is inclusive of electricity
charges and that is why alleged amount of Rs.2,000/- for electricity
has not been mentioned in the above-said legal demand notice.
Be that as it may, defendant is directed to appear
physically on the NDOH and he is also directed to restore the
electricity connection forthwith in the shop of the plaintiff i.e.
Shop bearing no. 1533, Shiv Ashram, S.P. Mukherjee Marg,
Behind Novelty Fire Station, Delhi. This interim relief shall
remain in force till the NDOH.
List the matter on date already fixed i.e. on
