AR of defendant is absent despite specific directions.
As per report of the Ahlmad, WS has been filed on behalf of defendant on
09.06.2026. The WS is supported with an application seeking condonation of delay. Let
spare copy thereof be placed on record. Let the same be released to the opposite side
against proper acknowledgment, as per rules.
The application seeking condonation of delay is filed on the ground that
even though the summons were received on 02.04.2026, page no.4 of the plaint was
missing and defendant was unable to prepare the WS. It is further stated that such
missing page was supplied to the defendant only on 06.05.2026, which led to filing of
the WS on 09.06.2026.
Arguments heard and record has been perused.
In the interest of justice, the WS is taken on record subject to cost of
Rs.3000/- to be paid by the defendant to the plaintiff on the NDOH.
Application is disposed off accordingly.
AR of defendant shall remain present in person on the NDOH, failing
which further cost of Rs.5000/- shall be imposed upon the defendant.
Be adjourned for framing of issues for 03.10.2026.
