Present: Ms. Priya Kakran, Ld. Counsel for plaintiffs along
with plaintiffs in person.
None for the defendant.
Perusal of the file shows that the plaintiffs have filed
the present suit against the Delhi Jal Board for permanent
injunction from being terminated from the service. Therefore, the
present dipsute pertains to the employer-employee relationship,
which is governed by a special statute and this Court lacks the
subject matter jurisdiction to entertain the suit. Therefore, the
present plaint along with the annexed documents are ordered to
be returned as per Order VII Rule 10 CPC with liberty to the
plaintiffs to approach the appropriate forum.
Ahlmad is directed to return the plaint along with the
annexed documents to the plaintiffs against the certified copies of
the same which are to be retained on record.
Copy of this Order be given dasti to the Ld. Counsel
for plaintiffs/plaintiffs, as per rules.
File be consigned to the record room after due
compliance.
