This is an application 151 CPC to set aside the
decree dated 31.07.2023 allegedly obtained by DH/non applicant
by playing fraud on the court.
Argument on behalf of applicant heard.
It is observed that provision of section 151 CPC
cannot be exercised to set aside decree allegedly obtained by
playing fraud, as the applicant has certainly the remedy to raise
the question of non execution of decree by raising objections in
the execution proceedings or by way of filing a separate civil suit
in this regard.
In view of aforesaid discussion, present application
is hereby dismissed as not maintainable.

file.
