Copy already supplied to the opposite party. Proof of service filed. Taken on record. Despite opportunity, no reply has been filed by the opposite party. By way of present application, the plaintiff seeks to substitute the erstwhile SPA with the new SPA namely Sh. Gaurav Sharma. It is stated in the application that the erstwhile SPA namely Sh. Ajay Kumar Sharma has expired on 10.03.2026. Copy of death certificate filed. Taken on record. In view of the above, the present application is allowed and the substituted SPA is taken on record. Since, the erstwhile SPA was not cross examined by the defendant, his chief examination cannot be read in the present matter. Accordingly, let fresh evidence by way of an affidavit be filed within three weeks with advance copy to the opposite party. Put up for PE on 26.11.2026.
