Present: Sh. Hanu Parashar, ld. proxy counsel for plaintiff.
Sh. Vipin Kumar and Ms. Vashu Gupta, Ld. proposed Counsel
for all the LRs of the defendant with LR No.1 in person.
No plaint and documents were filed for effecting service upon
LRs No.(ii) & (iii) of defendant, hence, process not issued.
Ordinary process not received back qua LR No.(i).
Ld. proposed counsel for LRs of defendant undertakes to file
his Vakalatnama in due course.
Today, it is submitted by LR No.(i) that she received the
Court’s summons on 27.01.2024. Since, no report has been received back, all
the LRs of defendant are deemed to be served on 27.01.2024.
The stipulated period provided under CPC for filing the written
statement still remains. Let all the LRs of defendant file written statement within
stipulated period as provided under CPC with advance copy of the same to
opposite side at least seven days prior to the date fixed along with appropriate
application for appointment of LR No.(i) as guardian of other two minor LRs.
