Today, the matter is listed for filing of replication as well as for framing
of issues.
At this stage, it is submitted by the Ld. counsel for the plaintiff that he
does not wish to file replication.
Pleadings are complete. From the pleadings of the parties, following
issues are framed for trial:
1. Whether the plaintiff is entitled for recovery of
Rs.2,97,810/- as prayed for? OPP.
2. Whether the plaintiff is entitled for pendente-lite and
future intererst @ 12 % per annum ? OPP.
3. Whether the present suit is not maintainable in view of
the payment of gratuity act ? OPD.
4. Whether the present suit is barred by limitation? OPD.
5. Relief.
No other issue arises nor pressed for.
To come up for plaintiff’s evidence, on 18.07.2025. Plaintiff is directed
to file affidavits of all the witnesses on or before the next date of hearing with advance
copy of the same to opposite party at least 15 days prior to the date fixed. Both the
parties are directed to file list of witnesses, within 15 days from today with advance
copy to each other.
