WS filed alongwith an application u/o VIII Rule 1
CPC for condonation of delay of 90 days. Copy supplied. Proof
of service through email filed.
Heard. Perused.
It is no gainsay that procedure is the handmaid of
justice and procedural delays should not be allowed to subvert
the very cause of justice. Every effort should be made to hear the
parties on merits. Moreover, the grievance of plaintiff regarding
delay can be duly compensated by way of cost. Hence, the
application seeking condonation of delay is hereby allowed and
WS is taken on record, subject to cost of Rs. 1,000/- to be paid to
plaintiff on NDOH.
Let replication, if any, be filed on the NDOH with
advance copy to opposite side against receipt.
Let affidavit of admission/denial of documents be
also filed by both the parties and proposed issues, if any, on the
NDOH.
List for completion of pleadings / filing of affidavit
of admission/denial of documents / settlement of issues on
30.01.2025.
