From the pleadings of parties and submissions
made, the following issues are settled:
1. Whether the present suit is barred by limitation? OPD
2. Whether the plaintiffs have not filed the requisite Court
fee? OPD
3. Whether the plaintiffs are entitled to a decree of partition
determining the share of tenancy of plaintiffs in the suit
property? OPP
4. Whether the plaintiffs are entitled to a decree of permanent
injunction, as prayed for? OPP
5. Whether the plaintiffs are entitled to a decree of
declaration, as prayed for? OPP
6. Relief.
No other issue arises or pressed by the Ld. Counsels.
Issue no. 1 and 2 will be treated preliminary issues
and will be decided first.
Ld. counsel for plaintiffs submits that he will move
an appropriate application to amend prayer clause (d).
Put up for arguments on preliminary issue no. 1 and
