Matter could not be settled between the parties.
Perusal of the record shows that vide order dated
29.01.2026, WS was taken on record subject to cost of Rs.500. Same has
not been paid. Ld. counsel for the defendant undertakes to pay the same
during the course of the day failure of which WS shall be taken off the
record.
Affidavit of admission denial filed by the plaintiff. Taken
on record. Ld. counsel for the defendant submits that he has e-filed his
affidavit of admission denial. Let the same be filed physically within
three days from today.
Pleadings are complete. From the pleadings of the parties,
following issues are framed for trial:
1. Whether the plaintiff is entitled for a
recovery of Rs.2,00,000/- as prayed for?
OPP.
2. Whether the plaintiff is entitled for
recovery of interest amounting
Rs.44,000/-? OPP.
3. Whether the plaintiff is entitled for a
pendente lite interest? OPP.
4. Relief.
No other issue arises nor pressed for.
To come up for plaintiff’s evidence, on 28.07.2026.
Plaintiff is directed to file affidavits of all the witnesses on or
before the next date of hearing with advance copy of the same to
opposite party at least 15 days prior to the date fixed. Both the
parties are directed to file list of witnesses, within 15 days from
today with advance copy to each other.
