Present : Ld. Counsel for petitioner.
None for SDM, Civil Lines.
Cost imposed upon the petitioner vide order dated 13.03.2026 has not
been deposited. Let the said cost be deposited during the course of the day, failing
which the same shall be enhanced.
As per report of the Ahlmad, notice issued upon SDM Civil Lines received
back served. However, none has appeared on their behalf.
On filing of PF, issue notice under Order 16 Rule 12 CPC for service upon
the SDM Civil Lines to appear on NDOH alongwith Surviving Member Certificate of
the deceased.
Ld. Counsel for petitioner has apprised that part of the securities of the
deceased is also the cash amount seized from the deceased who happens to be accused in
FIR No. 185/25, PS:Wazirabad. However, petitioner has not taken any steps for proving
such securities on record.
Ld. Counsel for petitioner submits that he has applied for certified copy of
records of such case and he shall file the same before NDOH.
Let appropriate application for summoning of witness qua aforesaid
securities be filed by the petitioner within a week from today.
Petitioner shall remain present in person on the NDOH.
Be adjourned for 16.07.2026.
