SANGITA MAINI VS. ANIL KUMAR JAIN AND ORS.
    15.09.2025
Fresh application u/o IX Rule 13 CPC seeking the
relief to set aside the eviction order dated 22.11.2024 passed u/s
    14(1) (e) r/w section 25 B of DRC Act filed through e-filing. It

Present :- Sh. Rahul Kaul, Ld. Counsel for Applicant.
This is an application u/o IX Rule 13 CPC seeking
the relief to set aside the eviction order dated 22.11.2024 passed
    u/s 14(1) (e) r/w section 25 B of DRC Act.
It is observed that as per section 25 B (8) of DRC
Act , the only remedy available with the respondent/tenant is to
file the revision petition and therefore, present application is
certainly not maintainable. Again as reflected from the record
filed by the applicant himself, the said eviction order has been
    already executed.
Adjournment sought on behalf of applicant to satisfy
the court regarding maintainability of present application.
At request, only one opportunity is granted and now
file be put up on 18.10.2025 for arguments on maintainability of
    the present application.
