Arguments on application u/o XXII Rule 3 CPC heard.
Ld. Counsel for defendant no. 2 submitted that he has no
objection, if the said application is allowed.
Considering the submissions, contents of the
application of plaintiff and no objection is accorded, application in
hand is allowed and disposed off.
Legal heirs of deceased plaintiff are substituted as LRs
of plaintiff.
From the pleadings of parties and submissions made,
the following issues are settled:
1. Whether the plaintiff /LRs are entitled to decree of
declaration as prayed in prayer clause (a)? OPP
2. Whether the plaintiff /LRs are entitled to decree of
permanent injunction as prayed in prayer clause (b)? OPP
3. Relief.
No other issue arises or pressed by the Ld. Counsels.

Parties are directed to file their list of witnesses and
original documents, if any, within 15 days from today stating the
details of the witnesses and the purpose they have to be examined.
Now to come up for PE on 03.07.2026.
