The relief of mandatory injunction sought by the
plaintiff stands satisfied in view of status report dated 28.02.2024
filed by defendant No. 3/MCD.
Pleadings are complete. Same are perused. No
admission denial is pressed for. From the pleadings of the parties,
following issues are framed for trial:
1. Whether the defendant No. 1 and 2 have been
throwing debris, garbage etc. on the roof of property
No. 1546, ground floor, Gali Jair, Satta, near
Marwari School, Nai Sadak, Delhi? OPP
2. Whether the plaintiff is entitled to the decree of
permanent injunction as prayed in the plaint? OPP
3. Relief.
No other issue either arises or is pressed for. List of
witnesses be filed within 15 days from today. The plaintiff is
directed to supply advance copy of affidavits to the opposite
party at least 7 days prior to the next date of hearing.
