registered.
Present : Ms. Minakshi Aggarwal and Ms. Aadesh Lakda, ld. counsel
for the plaintiff.
It is submitted by the Ld. counsel for plaintiff that she will file
the correct memo of parties within two days.
Submissions heard.
Let summons for settlement of issues and notice of temporary
injunction application be issued to the defendants on filing PF and RC as
well as all electronic modes returnable on 21.11.2023. The plaintiff shall
file copies of plaint and documents along with coloured photographs and
site plan, if any to be sent with the summons. MCD is directed to inspect
the suit property and file status report on the next date of hearing along
with measurements, site plan and coloured photographs. In the status
report, MCD is directed to mention the complete details of the present
construction in the suit property. Copy of order be sent along with the
summons. Steps be taken within 7 days from today. Defendant should file
his written statement of defence within 30 days from the date of
service/receipt of summons. A noting to this effect be made on the
summons.
