Present :- Petitioner in person.
Perusal of file shows that the respondent was served on
04.10.2023 through his brother on 1st address and 2nd address through
his son- in-law. However, none has appeared on behalf of respondent
and no leave to defend has been filed till date.
Ld. Counsel for the Petitioner has submitted on last date
of hearing that respondent has been served on 04.10.2023 and no
leave to defend has been filed on her behalf. It is further submits that
the present petition is liable to be allowed in view of settled law as the
leave to defend has not been filed.
I have heard learned counsel of the applicant.
In view of submissions, present eviction petition is
allowed. Hence, as a consequence thereof, an eviction order is passed
U/s. 14 (1) (e) of DRC Act in favour of petitioner and against the
respondent in respect of Shop No. 8, Ground Floor, Measuring
about 5.76 Sq. Yards, property No. 111/3065, Gali Kalyan Singh,
ram Bazar, Mori Gate, Delhi-110006 shown in the site plan filed
with the petition (for the purpose of identification). However, this
order shall not be operative before the expiry of six months from
today keeping in view Sec. 14(7) of D.R.C. Act.
File be consigned to the Record Room after
duecompliance.
