This is the 2nd call since morning.
It is submitted by Ld. Proxy counsel for plaintiff that main
counsel is not available as he has to appear before the some authority due to
a show cause notice issued against his mother and seeks adjournment.
Perusal of record shows that plaintiff is not pursuing the
present suit on merits and is not advancing arguments on application u/o
XXXIX Rule 1 & 2 CPC despite serval opportunities granted. Further
perusal of record shows that interim relief was granted to the plaintiff on
21.02.2026 since then adjournments are sought on behalf of the plaintiff.
Plaintiff has not even filed the replication despite making submission to file
the same and despite opportunities being granted. It appears that plaintiff is
not interested in pursuing the application u/o XXXIX Rule 1 & 2 CPC on
merits and hence, considering the conduct of the plaintiff, the application
of plaintiff u/o XXXIX Rule 1 & 2 CPC filed alongwith the plaint is
dismissed and disposed off.
Interim relief granted vide order dated 21.02.2026 is also
vacated.
At this stage, Ld. Proxy counsel requested for any date only
on Mondays.
Considered.
Now to come up for FP on 07.12.2026.
