today.
The present petition has been filed by the petitioner under Section 27 of

During the course of arguments, Ld. Counsel for respondent submits that the
present petition may be allowed without prejudice to the rights and contentions of the
respondents.
It is trite that deciding the relationship of landlord and tenant between the
parties or the question of sub-letting is beyond the scope of the present petition. Keeping
in view that for the purpose of deciding the present petition, summary procedure is to be
adopted and that by the present petition, only permission for depositing rent is being
sought, the objections as raised in the present case need not be decided.
Objections filed are dismissed.
Hence, the present petition is allowed with a liberty to the respondent to
withdraw the rent deposited in this case without prejudice to his rights and contentions.
File be consigned to record room after due compliance.
