Fresh Vakalatnama has been filed on behalf of the
defendant no.1. Same is taken on record.
Ld. counsel for defendant no.1 states that certain
pages of the plaint and documents have not been received.
Summons issued upon defendant no.2 received back
executed upon defendant no.2 on 31.07.2024.
Summons issued upon defendant no.3 received back
executed upon SI Sudhir Rathi on 31.07.2024.
The court fails to understand as to how summons
issued upon defendant no.3 SHO PS Burari were served upon SI
Sudhir Rathi and not served upon the SHO himself or the Dak
Clerk or any other authorized officer.
Let notice be issued to the Process Server to appear
and explain the circumstances vide a written reply, in which
summons were served upon defendant no.3 in such manner.
Further, none has appeared on behalf of defendant
no.2 despite repeated calls, however, the statutory period of filing
WS of defendant no.2 has not expired.
Accordingly, defendant no.2 is at liberty to file WS
within statutory period.
At request, let fresh summons be issued upon
defendant no.3 upon filing of PF within 07 days.
