This is a summary suit.
Summons issued to the defendant in the prescribed proforma under
Order 37 C.P.C. vide physical mode have been received back unserved with report
that address could not be traced.
Ld. Counsel for the defendant submits that the defendant has
received the summons under Order 37 C.P.C. vide registered post on 25.08.2025.
The registered post envelope is seen and returned to the defendant. This is valid
service.
An application under Order 7 Rule 10 r/w Section 20 & 21 of the
C.P.C. is filed qua return of plaint. Same is taken on record. Copy supplied. Reply
be filed on NDOH. Advance copy of the same be supplied to the opposite party
atleast a week prior to NDOH.
Fresh vakalatnama filed on behalf of defendant by the Counsel. Same
is taken on record.
Ld. Counsel for the defendants submits that the defendant shall file
affidavit for entering appearance on the NDOH alongwith requisite application.
Advance copy of the same be supplied to the opposite party atleast a week prior to
NDOH.
Put up for further proceedings on 10.11.2025.
