Defendant has not entered appearance by filing affidavit under Order
37 Rule 2(3) C.P.C. Ld. Counsel for the defendant submits that he shall file the
same with condonation application shortly.
An application has been filed on behalf of the plaintiff on 27.09.2025
under Order 37 Rule 2(3) r/w Section 151 C.P.C. for pronouncement of decree.
Same is taken on record. Copy supplied.
An application is filed on behalf of the defendant under Order 14
Rule 2 (2) C.P.C. for deciding issue of territorial jurisdiction as a preliminary
issue. Same is taken on record. Copy supplied. Ld. Counsel for the defendant has
withdrawn the application under Order 14 Rule 2(2) C.P.C. and given
endorsement to this effect on the application. Same is disposed off as withdrawn.
An application is filed on behalf of the defendant for leave to defend
under Order 37 Rule 3(5) r/w Section 151 C.P.C. Same is taken on record. Copy
supplied. Reply be filed on the NDOH. Advance copy of the same be supplied to
the opposite party atleast a week prior to NDOH.
Ld. Counsel for the plaintiff does not intend to file reply to the
application under Order 7 Rule 10 r/w Section 20 & 21 of the C.P.C. and is ready
to argue the same.
Arguments heard.
Put up for orders on the aforesaid application on 06.12.2025.
Written submission, if any /relied upon citations may be filed by the
parties within a week from today.
