Fresh vakalatnama filed on behalf of respondent No.8. Taken
on record.
Cost imposed upon the respondent No. 8 vide order dated
01.10.2024 has not been deposited.
Be deposited before NDOH, failing which further cost shall
be imposed.
It is submitted on behalf of respondent no. 8 that the file
regarding the deceased Sh. Dalbir was received in the office of respondent
No. 8 on 29.12.2023 and it was returned back to the BSES Yamuna on
15.01.2024 for certain clarifications. However, upon query regarding what
clarifications, the Assistant Manager of respondent No. 8 is silent and he
is completely unaware.
It has been apprised by the Ld. counsel for petitioner that as
per the reply of respondent No. 7, benefits of gratuity, GPF, employee
deposit link, insurance, leave encashment and pension are to be made by
respondent No. 8. Therefore, it appears that respondent No. 7 and 8 are
both trying to throw the ball in the others court to avoid their liability.

Let fresh notice of the petition alongwith copy of this order
be sent to the respondent No. 7 / BSES Yamuna, who shall appear
alongwith relevant record of the deceased on next date and the status of
clarifications, if any that they have given to respondent No. 8.
The head of the department of respondent No. 8 is also
directed to remain present in person alongwith complete details and
clarifications in respect of aforesaid.
Be put up for further PE on 03.02.2025.
