Present : Sh. Anmol Chadha, Ld. Counsel for the plaintiff.

At this stage, an application u/o 8 Rule 1A r/w
Section 151 CPC has been filed on behalf of defendant to bring

From perusal of the WS, it transpires that page

of WS of defendant no.1, though, pagination of the same is not
proper. Ld. proxy counsel for defendant was apprised of the said
fact, whereupon, after seeking instructions from the main
counsel, Ld. proxy counsel counsel for defendant submits that the
defendant wishes to withdraw the aforesaid application.
Endorsement of defendant as well as Ld. proxy
counsel for the defendant to this effect is taken on the application
itself.
In view of the aforesaid, the application u/o 8 Rule
1A r/w Section 151 CPC is dismissed as withdrawn.
Matter is also pending for cross examination of
PW1/Virendra Singh. Witness is present.
Initially, Ld. proxy counsel for defendant sought
adjournment to cross examine PW1 on the ground that main
counsel is not available today. However, looking at the past
conduct of the defendant, court apprised to Ld. proxy counsel
that the adjournment, if any, will be granted only after imposition

submitted that the main counsel will join through VC by 11:00
am and will conduct cross examination of the witness. However,
despite waiting till 11:15 AM, the main counsel for defedant has
not joined, whereupon, after seeking instructions from the main
counsel, Ld. proxy counsel for defendant submitted that the
defendant himself shall cross examine the plaintiff’s witness, as
he has been apprised of all the necessary questions to be asked
from plaintiff’s witness in cross examination.
Accordingly, PW1/Virendra Singh cross examined
by defendant and discharged.
Vide separate statement of the plaintiff, PE stands
closed.
Renotify for DE on 07.09.2026.
