ASHIND INDUSTRIES PRIVATE LIMITED
Vs.
OM PARKASH BANSAL
13.01.2026
Present : Sh. Ankit Verma, Ld. Counsel for the plaintiff.
Sh. Raj Kumar, Ld. Counsel for defendant.
Matter is at the stage of completion of pleadings.
At this stage, WS filed on behalf of defendants
alongwith an application for condonation of delay.
Submissions heard on the application for
condonation of delay.
It is submitted by Ld. Counsel for defendant that
earlier counsel did not pursue the matter diligently despite
payment of necessary fees by the defendant and the defendant
has placed on record proof of payment made by him to the
previous counsel. It is therefore submitted that due to lack of
diligence on the part of previous counsel, WS could not be filed
within prescribed time period.
Application is strongly opposed by Ld. Counsel for
the plaintiff that the defendant has been duly served with all the
copy of plaint and documents on 10.10.2025 and, therefore, the
present WS filed beyond the stipulated period, should not be
taken on record. Ld. counsel further submitted that if the Court
deems it appropriate to condone the delay, then the defendants
should be burdened with heavy cost.
Heard.
In view of submissions and facts on record, the
application for condonation of delay stands allowed and WS filed
