Fresh Execution Petition received by way of e-filing. It be checked
and registered as per rules.
Present : Sh. Gaurav Kashyap Ld. Counsel for the DH.
Sh. Ankit Kaushal, Ld. Counsel for the JD.
Ld. Counsel for the JD/MCD has been called by the
the Court and informed that today few fresh execution matters are
listed and hence his presence is necessary in order to avoid any
adversity/multiplicity of payments from the public money.
Ld. Counsel representing MCD has duly appeared and
submits that today he is filing his memo of appearance and he needs
some time to verify from the department whether any prior payment
has been made to the Workman concerned or not and also in order
to avoid multiplicity of cases, time may be granted to file relevant
objections.
Submissions found to be meritorious. Time is granted.
Keeping the submissions in mind, notice is served
upon the MCD.
Sh. Ankit Kaushal accepts notice on behalf of the JD.
At request, copy of the execution petition be supplied
to the Ld. Counsel for JD, against receiving.
Let a report be called from the Civil Nazir on the next
date of hearing.
Matter be taken up for the report of the Nazir and for
further proceedings/objections on 01.08.2024.
