Cost of Rs. 2,000/- paid to Ld. counsel for plaintiff.
Vide order dt. 30.08.25, application of the defendant
u/o IX rule 7 CPC was allowed and the defendant was directed to
file the WS within 30 days from 30.08.25. More than 58 days
have lapsed, but till date the WS has not been filed.
It is submitted by Ld. counsel for defendant that he
had received the copy of the plaint on 25.10.25 and had also
received the certified copy of the plaint on the same date. On the
contrary, it is submitted by plaintiff that the defendant has
himself admitted in his application u/o IX Rule 7 CPC in para no.
4 and 7 that the defendant was served with summons and had
received the copy of the plaint. In the interest of justice, one last
opportunity is granted to the defendant to file WS, subject to cost
of Rs. 1,000/- payable to plaintiff on NDOH.
Let WS be filed before NDOH with advance copy to
opposite side against receipt, after which, replication, if any, be
filed on the NDOH with advance copy to opposite side against
receipt.
List for completion of pleadings/further proceedings
on 15.11.2025.
