Sh. Kartikey Mittal, Ld. counsel for defendant.
On perusal of order sheets, it is revealed that
numerous opportunities have been given to the plaintiff to file the
replication, but till date replication has not been filed. In view of
above, right of the plaintiff to file replication is hereby closed.
From the pleadings of parties and submissions
made, the following issues are settled:
1. Whether the plaintiff is entitled to recovery of amount as
prayed in payer clause? OPP
2. Whether the plaintiff is entitled to pendentelite and future
interest? If yes, at what rate and for what period? OPP
3. Relief.
No other issue arises or pressed by the Ld. Counsels.
Parties are directed to file their list of witnesses and
original documents, if any, within 15 days from today stating
details of witnesses and the purpose they have to be examined.
Put up for PE on 30.01.2026 for which plaintiff is
directed to file affidavit of all PWs by next date of hearing after
supplying advance copies of the same to opposite counsels at
least 7 days prior to next date of hearing, failing which, cost of
Rs. 5,000/- will be imposed payable to the opposite side.
