Present : Ld. Counsel for petitioner alongwith petitioner.
None for SDM, Vivek Vihar despite service.
As per report of the Ahlmad, notice issued upon respondent no.6 received
back unserved.
At request, on filing of PF / RC and email/Whatsapp number within seven
days from today, issue fresh notice of present petition to the respondent no.6 through all
permissible modes to appear on NDOH alongwith relevant record of the deceased.
Ld. Counsel for petitioner submits that he would file the Surviving Member
Certificate of the deceased on the NDOH. Let the same be filed on the NDOH.
Ld. Counsel for petitioner has apprised that he has filed an application
under Order I Rule 10 CPC read with Order VI Rule 17 CPC to bring on record the
details of Ms. Vimla Gupta i.e. post deceased daughter of the deceased.
On filing of PF and RC within seven days from today, issue notice of
aforesaid application to all the LRs of Ms. Vimla Gupta as stated in the application, for
service upon them returnable on NDOH.
On filing of PF, issue notice under Order 16 Rule 12 CPC for service upon
the SDM, Vivek Vihar to appear on NDOH alongwith Surviving Member Certificate of
the deceased.
