Present: Sh. Rachit Gupta, Ld. counsel for plaintiff through
VC.
Ld. counsel for plaintiff submits that settlement talks are
going on between the parties.
Perusal of the record shows that plaintiff has not taken
any steps for service of summons upon the defendant since last three
dates of hearing.
The excuse made by the Ld. counsel for the plaintiff
regarding settlement talks is not sufficient to justify the not filing of
PF since 14.07.2025.
Vide last order, final opportunity was granted to the
plaintiff to take the steps, however she failed to do so the needful.
In view of the above, it appears that plaintiff is not
interested in pursuing the present case. However, considering the
request of the ld. counsel for the plaintiff, one last opportunity is given
to the plaintiff to take the steps for service upon the defendant subject
to cost of Rs.2000/- to be deposited in DLSA, Central. The receipt of
the same shall be filed alongwith the PF.
Issue fresh summons to the defendant through all modes
including electronic mode i.e. Whatsapp/E-mail upon filing of PF/RC
and receipt of deposit of cost within 15 days returnable for NDOH.
In case summons has to be served through electronic
mode, plaintiff is directed to file affidavit containing the details of the
Whatsapp number, E-mail ID etc. of the defendant alongwith the PF.
