Written statement has been filed on behalf of defendant
along with an application under Order 8 Rule 1 CPC for condonation of
delay in filing the written statement. Furthermore, reply to the
application under Order 39 Rule 1 & 2 r/w Section 151 CPC has been
filed on behalf of defendant along with an application under Order 7
Rule 11 CPC. Same is taken on record. Copy supplied.
Ld. Counsel for defendant submits that inadvertently the
written statement could not be filed by defendant within the prescribed
period due to the reasons as mentioned in the application and prays that
the application be allowed and the written statement filed by defendant
be taken on record.
Ld. Counsel for plaintiff has opposed the said application.
In the interest of justice and keeping in view the settled
principle of law that procedure should be used to subserve and advance
the cause of justice, the application filed on behalf of defendant under
Order 8 Rule 1 CPC for condonation of delay in filing the written
statement is allowed subject to cost of Rs. 1000/- to be paid by
defendant to plaintiff.

At this stage, it is submitted by both the parties that there
are chances of amicable settlement in the present matter and
accordingly, both the parties request that the matter may be referred to
Mediation Centre.
In view of the submissions made, matter is hereby
referred to Mediation Centre, Tis Hazari Court for settlement, if any.
Parties are directed to appear before Mediation Centre, Tis
Hazari Courts on 02.08.2024 at 2:00 pm.
Put up for report on settlement/further proceedings on
19.09.2024.
