Nazir report filed and as per the Nazir report, order dated
18.10.2024 passed by Hon’ble High Court of Delhi. It is also reported
that DH has not filed certified copy of site plan.
At this stage, an application u/o XXI Rule 26 & 28 CPC
has been filed on behalf of JD alongwith copy of order dated
22.07.2025 passed by Hon’ble High Court of Delhi and it is submitted
that vide said order, the notice has been issued to the respondent in the
revision petition (DH herein) to be served including upon counsel
appearing in the execution proceedings listed for 29.07.2025 i.e.
today. Copy of said notice alongwith copy of some documents have
been filed today and it is further submitted that same has also been
sent to the opposite counsel. Counsel for DH is also granted liberty to
collect the same from the Nazir.
Same has been duly apprised to the counsel appearing on
behalf of DH and he has been further apprised the NDOH fixed before
Hon’ble High Court of Delhi is 27.08.2025.
At this stage, it is further submitted on behalf of DH as
there is no stay granted by Hon’ble High Court of Delhi, warrant of
possession may be issued. However, warrants cannot be issued at this
stage for not filing of certified copy of site plan.
Now file be put up on 06.09.2025 for further
proceedings.
