Present: Sh. Vipin Raturi, Ld. Counsel for the plaintiff along with the

Ld. Counsel for the plaintiff has filed the plaint and
documents in physical form today. The same are taken on record.
I have carefully perused the case file and heard the arguments
on the point of maintainability of the present suit.
It is submitted by Ld. Counsel for the plaintiff that there is
urgency in the present matter, and the question of maintainability be
deferred for the next date of hearing. Request is allowed.
Ld. Counsel for the plaintiff is directed to furnish the email
I.D. or Whatsapp mobile phone number of defendant accompanied with
an affidavit and PF/RC within 5 days from today so that service could be
effected upon the defendant.

Ahlmad is directed to issue summons for settlement of issues
to the defendant on receipt of the PF/RC.
On taking steps i.e. whatsapp mobile phone number or email
I.D. of defendant accompanied with an affidavit and PF/RC, issue
summons for settlement of issues and notice of the application U/o 39
Rule 1 & 2 r/w Sec. 151 CPC to the defendants for 13.07.2023.
It is clarified that the question of maintainability is kept open.
