behalf of DH for early hearing.
Present :- Sh. Mohd. Ahmed, Ld. Counsel for DH.
Vide present application, DH is seeking early
hearing stating that vide order dated 12.07.2023 the court issued
fresh warrant of possession against the JD but inadvertently PF
was filed in Ld. ACJ Court instead of this court. Hence, prayer is
made to issue fresh warrant of possession against the JD and
appointment of bailiff.
In view of the same, present application is allowed.
Let fresh warrant of possession be issued against the JD in terms
of order dated 12.07.2023 and DH is directed to appear before
Ld. ACJ for appointment of Bailiff on 04.08.2023 and for report
on 31.08.2023. NDOH i.e 09.08.2023 stands cancelled.

As per Nazir report, there is no stay order.
Ld. Counsel for DH submits that there is no stay against
the judgment/order. In view of submissions made and material on
record, issue fresh warrants of possession against the JD and in favour
of the DH, as per the certified copy of the site plan, subject to filing of
PF. Further, Bailiff is directed to remove all hurdles including lock,
doors etc. in order to execute present warrants of possession Further,
Bailiff is directed to take all other necessary auxiliary steps for
execution of present warrants of possession. DH shall file an
affidavit to the effect that there is no stay or appeal pending on the
execution of the eviction order. Concerned SHO is directed to provide
police aid and assistance including lady police officer, if required, to
the Bailiff for execution of warrant of possession.
DH is directed to appear before Ld. ACJ for appointment
of Bailiff on 25.07.2023 for report on 09.08.2023.
