Present: Sh. M.N. Khan, Ld. counsel for plaintiff.
Process not issued despite filing of PF upon defendant
no.2. Ahlmad states that the same was not issued as the PF was filed
late.
Receipt of cost in terms of order dated 23.01.2025 has
been filed on behalf of the plaintiff.
An application U/O 6 Rule 17 r/w Section 151 CPC has
been moved on behalf of the plaintiff.
Ld. counsel for the plaintiff states that the plaintiff
simply wishes to correct the name of defendant no.1 in the plaint and
no prejudice shall be caused to the defendants as they have not yet
been served.
Submissions heard. Record perused.
In view of the submissions made, it is observed that the
proposed amendment is essential for just decision of the case and no
prejudice shall be caused to any party if the present application is
allowed.
In view of such observations, application U/O 6 Rule 17
r/w Section 151 CPC moved on behalf of the plaintiff is allowed. Ld.
counsel for plaintiff seeks time to file amended plaint. Considered.
Same be filed within 15 days.
An application U/O 5 Rule 20 CPC has been filed on
behalf of the plaintiff. The application can be considered after filing of
amended plaint.
Now to come up on 26.07.2025.
